B.C. introduces 15% real estate tax targeting foreign homebuyers

VANCOUVER -- Foreign nationals who buy real estate in Metro Vancouver would pay an additional property transfer tax of 15 per cent under legislation introduced Monday by the British Columbia government.

Finance Minister Mike de Jong unveiled the tax as part of legislation aimed at addressing low vacancy rates and high real estate prices in southern B.C.
"For example, the additional tax on the purchase of a home selling for $2 million to a foreign national will amount to an additional $300,000," de Jong told members of the legislature.

The additional tax will take effect Aug. 2 and apply to foreign buyers registering the purchase of residential homes in Metro Vancouver, excluding treaty lands in the Tsawwassen First Nation.

All B.C. residents currently pay a one per cent tax on the first $200,000 of their purchase, two per cent on the remaining value up to $2 million and three per cent on the portion above that.

"The amendments include anti-avoidance rules designed to capture transactions that are structured specifically to avoid the additional tax," de Jong said.
The money from the additional tax would be used to fund housing, rental and support programs, the minister said.

De Jong said recent government housing data indicate foreign nationals spent more than $1 billion on B.C. property between June 10 and July 14, with 86 per cent on purchases in the Lower Mainland area.

After the bill was introduced, Premier Christy Clark said her government is focused on increasing the housing supply, protecting buyers and sellers and boosting the rental market.

"Today we are taking measures to ensure home ownership remains within reach of the middle class," she said.
The legislation would also enable the City of Vancouver to amend its community charter in order to levy a vacancy tax.
In May, de Jong said he wasn't in favour of a tax on foreign investment, saying he worried it would send the wrong message to Asia-Pacific investors.

Сейчас летом 86% сделок у нас было произведено иностранцами. Я думаю, что это отразится на рынке - часть покупателей уйдет. Недвижимость подешевеет. - Это вызовет новый подъем. Вобщем вверх-вниз будет идти. Но маловероятно, что рынок обрушится.

Вообще-то процент жилья, покупаемого иностранцами в Ванкувере, довольно низок, около 2%. Все те богатые китайцы, что скупают миллионные дома в Ване, иностранцами не являются. У них есть или PR или вообще гражданство, но живут они в своем Гонконге. Посему этот новый закон большого эффекта на цены на недвижимость иметь не будет.

Я тоже слышу отовсюду цифру 2-3%. Понятия не имею откуда взялись 86%, звучит совершенно нереалистично. НПГ, есть какая-нибудь ссылка на этот счет плиз?

Вот уже во втором издании написано про 86 % иностранцев: Data gleaned from the forms between June 10th and July 14th shows foreign buyers spent about $1-billion residential real estate in BC and 86 per cent of that was spent in the Lower Mainland.

Нам от этих подъемов - спадов толку малу. Дом вырос в цене - но мы же его не будем продавать. Вот и какое имеет значение его высокая цена? Только что проперти так поднимается в цене. Если цены вдруг обрушатся, я буду только рада: не только китайцы, но и канадцы смогут купить себе доступное жилье в нормальных районах. Может у детей появится больше шансов на покупку своего жилья.

Это ж не 86% иностранных покупателей, это 86% из всех денег, потраченных иностранными покупателями (2-3% от всех покупателей), были потрачены в Lower Mainland.

Дом вырос в цене - но мы же его не будем продавать. Вот и какое имеет значение его высокая цена?

Ну так не все же в такой ситуации как вы. Для вас это бесполезно, для многих других как в лотерею выиграли.

Вы себе даже представить не можете сколько проблем такое обрушение принесет с собой. Про экономический кризис 2008-го в США слышали?

Toronto may not follow BC’s example on foreign owners says mayor

The Mayor of Toronto says that he is in no hurry to make a decision on whether the city should be looking at cooling foreign investment with measures like those that will apply in BC from Monday.

John Tory told BNN that he has not drawn any conclusions on what should be done to cool the market based on what is going on elsewhere. He said that governments cannot micro-manage the market.

Ontario may introduce measures to take some of the pressure off the province’s home prices, especially in the GTA, however low supply is cited by many analysts as a more urgent problem than foreign investment.

Vancouver real estate tax sparks concerns for Toronto housing market

Toronto Mayor John Tory has said he would contemplate a real estate tax similar to Vancouver's but would have see evidence of its efficacy.

Toronto’s red-hot real estate market could get even hotter as foreign nationals looking to dodge a new 15 per cent tax on properties in Vancouver seek new places to invest, realtors say.

The tax, which takes effect Tuesday, was introduced by the British Columbia government with the intent of improving home affordability in Metro Vancouver, where house prices are among the highest in North America.

But it has also given rise to concerns that it could exacerbate Toronto’s housing market.

“Where are those foreign investors going to go?” said Derek Ladouceur, a Toronto real estate agent.

“They’re not going to want to pay that 15 per cent, so they’re going to now dump it into the Toronto real estate market, which is already hot.”

Ladouceur predicts that all segments of Toronto’s housing market will get pricier, from condos to detached single-family homes, but the luxury segment — where many foreign investors park their money — could see the biggest lift.

Dianne Usher, a Toronto-based realtor with Royal LePage, says some foreign buyers have already been flocking to Toronto as soaring home values have priced them out of Vancouver’s market.

“With an additional tax it will grow exponentially, in my view,” says Usher.

Ontario Finance Minister Charles Sousa has said he is examining the tax “very closely” as a possible measure to address Toronto home prices.

The average cost of a home in the city in June was $746,546, up nearly 17 per cent from the same month last year, according to the Canadian Real Estate Association. In comparison, Vancouver home prices averaged $1,026,207, a rise of more than 11 per cent.

Mayor John Tory said he hasn’t ruled out a similar tax for foreigners buying property in Toronto. But he stressed he would want to know more about its efficacy before bringing in such a levy.

“I think in the end what people want to know is this: they want to know that if we’re going to do anything, that it’s going to be effective, not that we’re going to do something for kind of show business or political purposes or even for revenue-generating purposes,” he said last week.

The B.C. government released data that showed one in 10 property sales from June 10 until July 14 in Metro Vancouver involved foreign nationals.

In Toronto, information on foreign buyers is more scarce, although a report from Canada Mortgage and Housing Corporation in April pegged the rate of foreign ownership in the city’s condo market at 3.3 per cent.

Brad Henderson, president and CEO of Sotheby’s International Realty Canada, said some foreign nationals could also snatch up properties in parts of British Columbia that aren’t subject to the tax, such as Victoria.

“Certainly I think Toronto and potentially other markets like Montreal will start to become more attractive, because comparatively speaking they will be less expensive,” said Henderson.

The country’s stable political environment, the low loonie and rock-bottom mortgage rates have also helped lure overseas investors, he said.

The rapid rise in house prices in Toronto and Vancouver has caught the attention of the Bank of Canada, which declared two months ago that they were not sustainable.

In recent years, Ottawa has implemented several measures to restrict mortgage lending in the face of rising house prices. Most recently, it increased the minimum down payment in February for new government-backed insured mortgages from five per cent to 10 per cent for a portion of a house price over $500,000.

CIBC economist says Ontario will have to tax foreign buyers

Ontario will have to follow BC in taxing foreign home buyers in order to cool the Greater Toronto Area housing market according to CIBC economist Benjamin Tal.

In a client note, Tal said that as evidence is starting to reveal an impact on the Vancouver market following the introduction of a 15 per cent tax, Ontario will have “little choice but to do the same.”

His assessment of the current state of the market and household debt is that there is a real risk ahead for the economy from large mortgages held by an increasing number of homeowners in the hottest markets.

While defaults may not rise sharply, higher interest rates could mean lower consumer spending on other items as servicing debt takes a larger chunk of household incomes.

This, Tal warns, could lead to recession and he is calling on the government to take action to make borrowing harder.

B.C. numbers show drops in foreign property buyers since targeted tax

Property purchase data released today by British Columbia's Finance Ministry indicates a stampede by prospective foreign buyers to avoid paying a 15 per cent tax in the days before the Aug. 2 deadline.

But the numbers also reveal the sudden rush slowed to a trickle after the deadline.

A ministry statement says that on July 29, the last business day before property transactions could be registered before the new tax took effect, 55 per cent of all residential property deals in Metro Vancouver involved foreign nationals.

The statement says more than $850 million in property transactions involving foreign nationals were registered at the land titles office on July 29.

Government statistics show declines in real estate transactions involving foreign nationals since the introduction of the foreign buyers tax.

The figures indicate 1,974 property deals in Metro Vancouver involved foreign buyers from June 10 to Aug. 1, but that number dips to just 60 property transactions involving foreign buyers from Aug. 2 to 31.

Foreign buyers are not the problem

Citing recently collected data, the Canada Mortgage and Housing Corporation announced on Wednesday (November 30) that foreigners represented only a miniscule segment of home owners in the country’s most active markets, and thus could not be considered as the main driver of the outsized price growth in the Canadian real estate sector.

The latest CMHC report noted that foreign nationals possess a mere 2.2 per cent of condo units in Vancouver and 2.3 per cent in Toronto.

“The evidence tells us that the origin of investor activity in Canadian real estate is primarily domestic,” CMHC president and CEO Evan Siddall said in a speech, as quoted by Metro Vancouver.

“When a white person buys a house, we don’t know. When a person of a different colour does, we do, and that’s not good economics.”

The numbers and comments backed up similar observations made by the B.C. government, which found that foreign money accounted for only 3.6 per cent and then 1.7 per cent of all sales in the province in September and October, respectively.

Despite speculations that the 15 per cent property transfer tax on foreign buyers caused the decline, however, Siddall emphasized that the market already demonstrated signs of slowdown prior to the implementation of the levy.

The CMHC head added that it was a potent blend of record-low interest rates, the rise of the investment housing trend, a growing population, and a healthier economy that is the ultimate driving factor in the price increases, and that the only reliable way to address the affordability issue is to improve supply via the removal of red tape to improve construction speed.
